| 09/29/2023 | DOCKET TEXT ORDER (no separate order issued:) This case is scheduled to come before the court on October 5, 2023 for a hearing on a motion for relief from stay (Dkt. 84; the "Motion for Relief from Stay") filed by Flagstar Financial & Leasing LLC f/k/a Signature Financial LLC ("Flagstar"). Flagstar has also filed a motion for an order compelling performance of lease obligations, allowing administrative claims, and compelling Debtor Professional Charter Services LLC ("PCS") to assume or reject an alleged lease (Dkt. 82; the "Motion to Compel"). Given that the Motion for Relief from Stay is so closely related to the Motion to Compel, the court believes they should be heard together. The court also believes the parties should meet and confer based on the guidance it offered in a tentative ruling issued September 11, 2023 (Dkt. 79) in a dispute involving a contract very similar to that between Flagstar and PCS. Accordingly, the court orders as follows: (1) The hearing on the Motion for Relief from Stay and the Motion to Compel are hereby continued to November 16, 2023 at 1:00 p.m. (2) The November 16 continued hearing will convene via Zoom. The court's website offers information explaining how to arrange an appearance at a video hearing. (3) Prior to the November 16 hearing, counsel for PCS and counsel for Flagstar shall meet and confer by telephone or video - not by email - in a good faith effort to resolve the motions.
