DOCKET TEXT ORDER
(no separate order issued:) This case is scheduled to come before the court on October 5, 2023 for a hearing on a motion for relief from stay (Dkt. 84; the "Motion for Relief from Stay") filed by Flagstar Financial & Leasing LLC f/k/a Signature Financial LLC ("Flagstar"). Flagstar has also filed a motion for an order compelling performance of lease obligations, allowing administrative claims, and compelling Debtor Professional Charter Services LLC ("PCS") to assume or reject an alleged lease (Dkt. 82; the "Motion to Compel"). Given that the Motion for Relief from Stay is so closely related to the Motion to Compel, the court believes they should be heard together. The court also believes the parties should meet and confer based on the guidance it offered in a tentative ruling issued September 11, 2023 (Dkt. 79) in a dispute involving a contract very similar to that between Flagstar and PCS. Accordingly, the court orders as follows: (1) The hearing on the Motion for Relief from Stay and the Motion to Compel are hereby continued to November 16, 2023 at 1:00 p.m. (2) The November 16 continued hearing will convene via Zoom. The court's website offers information explaining how to arrange an appearance at a video hearing. (3) Prior to the November 16 hearing, counsel for PCS and counsel for Flagstar shall meet and confer by telephone or video - not by email - in a good faith effort to resolve the motions. (4) No later than November 9, 2023, PCS and Flagstar shall file pre-hearing statements advising of the status of their efforts to resolve the motions and, if they have been unable to resolve the motions, advising of the legal and factual issues to be adjudicated. (4) The parties' pre-hearing statements shall not exceed 5 pages absent prior leave of court. (5) The parties shall calculate the deadlines for filing an opposition and a reply concerning the Motion to Compel from November 16, 2023. (6) The court finds and concludes that the need to afford the parties an opportunity to resolve the motions constitutes compelling circumstances under 11 U.S.C. § 362(e) that justify continuing the automatic stay in effect until otherwise ordered.
