08/22/2024 | DOCKET TEXT ORDER (no separate order issued:) This case came before the court on August 22, 2024 for a continued status conference. Appearances were as noted on the record. For the reasons stated on the record, the court orders as follows: (1) The status conference is hereby vacated. (2) Counsel for Debtor NJR Investments LLC, counsel for secured creditor Velocity Commercial Capital LLC, and counsel for secured creditor Julie's Deli LLC shall promptly meet and confer concerning appropriate deadlines for: (a) obtaining and/or accepting an offer for the purchase of Debtor's real property at 45 Visitacion Ave., Brisbane, CA ("Visitacion"); (b) close of escrow on the sale of Visitacion; (c) expedited consideration of a motion under 11 U.S.C. § 363(b) and (f) for authority to sell Visitacion (a "363 Motion"); and (d) possible remedies in the event Debtor proves unable to meet any of the relevant deadlines. (3) As to expedited consideration of a 363 Motion, the court hereby authorizes the parties to notice such a motion for hearing on any Thursday calendar at 10:00 a.m. on 14 days' notice, so long as opposition must be filed no later than the Friday prior to the hearing on the 363 Motion and so long as opposition does not exceed 10 pages, absent prior leave of court. That page limit shall not apply to any declaration(s) or request(s) for judicial notice that might be filed in support of such opposition. (4) If Velocity Commercial Capital LLC decides to file a motion for relief from stay, it may notice such motion for hearing at the same time as the 363 Motion, if any, or on any available 1:00 p.m. calendar. Motions for relief from stay may be noticed for hearing on 14 days' notice, pursuant to B.L.R. 4001-1(c). (5) The parties shall file a stipulation setting forth their agreement as to the issues described in (2), above, and shall submit a proposed order approving such stipulation, no later than August 30, 2024. (6) If the court does not receive a Stipulation and proposed order by August 30, 2024, it will set a status conference at the court's earliest convenience during the week of September 2, 2024.
