See D.I. 1068 & 1069.It is certainly true that a legal entity, unlike an individual, is required to appear through counsel, and cannot appear in court on a pro se basis. See Rowland v. Cal. Mens Colony, Unit II Men's Advisory Council, 506 U.S. 194, 201-202 (1993). The statement contained in the certification accurately recites language used in this Court's prior order. See D.I. 1015. That statement, however, neglected to account for this Court's Local Rule 9010-1(e)(iii), which permits out-of-state counsel to participate in claims litigation without associating with "counsel admitted to practice before this Court." This Court did not intend, through its prior order, to override the effect of Local Rule 9010-1(e)(iii). Because the certification represented that the informal objections at issue were raised by "an individual" rather than out-of-state counsel, the Court does not believe any corrective action is required. To the extent the issue were to arise in the future, however, the Court thought it appropriate to correct its prior statement and request that further communications by the post-communication debtors be amended accordingly.
