After discussion, the Court Finds and Concludes that based on the representations of counsel and the submissions on the record, that unless the Court authorizes interim use of cash collateral, the Debtor may suffer irreparable harm or damage. The Court will authorize the Debtor use of cash collateral through November 12, 2015, with the understanding that the final hearing is set for November 12, 2015, at 9:00 a.m. in Boise. Cash collateral to be used on a limited basis through November 12, 2105, as outlined on the record and noted in Exh B to the motion [per discussion of the Oct/Nov items (one-half of Nov), with the exceptions noted, such as rent, utilities, health insurance and insurance]. The parties will work together to ensure a complete budget with all the terms and conditions agreed to will be presented to the Court for approval. An adequate protection lien is granted to the secured creditors to the extent of any cash collateral used. The Court Orders and Directs that the Debtor schedule the initial interview prior to the date set for final hearing on cash collateral. The Court will authorize interim use of cash collateral on the basis that Debtor files its remaining schedules timely. Use of cash collateral is effective immediately. Mr. Robinson to submit an appropriate order that incorporates all terms and conditions noted on the record. Use of cash collateral is effective immediately. The order is to be approved by Ms. McConnell and Ms. Kimmel.
