08/15/202493Docket Text Order Regarding Debtor in Possession's Motion to Expedite Plan Confirmation Process. Whereas, as stated in the introductory language in paragraph 2 of 11 U.S.C. Section 105(d)(2)(B)(vi), a court may apply the statutory provision only if doing so will not be inconsistent with another provision of Title 11 of the United States Code or with applicable Federal Rules of Bankruptcy Procedure and whereas this case is neither a Subchapter V case nor a small business case entitled to treatment under 11 U.S.C. Section 1125(f)meaning 11 U.S.C. Section 1125(a) applies in this case, the Court hereby Orders that: (1) The requests for a conditional approval of the disclosure statement and a combined hearing on final approval of the disclosure statement and confirmation of the proposed plan of liquidation are denied. (2) With respect to the disclosure statement, the Clerk of Court shall issue a seven day bar date notice on parties in interest. If no objections are filed, the Court will enter an order approving the disclosure statement, setting a deadline for ballots and objections to the plan to be filed, and scheduling the confirmation hearing for next month.
