Order of the Court: The Court has reviewed the Motion to Reopen and to Waive or Defer the Reopening Fee. The Movant states grounds to reopen the case under Section 350. The Movant does not, however, state grounds to waive or defer the reopening filing fee. Filing fees are governed by 28 U.S.C. Section 1930. The Local Rule 5010-1 of course only implements Section 1930 and cannot serve as an independent basis to waive or defer a filing fee other than in accordance with Section 1930. Section 1930(f)(2) and (f)(3) authorize waiver or deferment of filing fees in certain circumstances, according to Judicial Conference policy; however, deferment is available only to trustees in certain circumstances, and Movant points to no provision of the Judicial Conference guidelines that would authorize the Court to waive the filing fee for a creditor seeking to reopen a closed case. Under the circumstances, the Court declines to exercise its discretion to waive the reopening fee. The reopening fee is due within 7 days; otherwise, the Motion to Reopen will be denied without prejudice. This Order shall not be construed as bearing of the merits of the Motion to Enforce Reorganization Plan, should indeed the Movant pay the filing fee and the Court reopen the case.
