11/20/202454ORDER AND NOTICE: On November 15, 2024, the court held a status conference in which the Debtor requested until November 22, 2024 to coordinate the inspection of secured creditor Commercial Equipment Finance, Inc.s (CEFI) collateral. The court ordered the parties to inform whether such inspection took place by the agreed date. See, Minute Entry, Dkt. # 53. 11/20/202453Minutes of Proceeding: The Debtor summarized the pending contested matters with secured creditor Commercial Equipment Finance, Inc. (CEFI) regarding insurance and the inspection of collateral. There is a final hearing to consider CEFIs motion for relief from stay scheduled for November 26, 2024. The Debtor suggested that the court grant them 7 days or until November 22, 2024 for them to facilitate access to CEFI for the inspection of its collateral and for the stay to be lifted without further notice or hearing upon the Debtors failure to comply with such deadline. The court noted that the motion for relief from stay was filed upon the Debtors failure to maintain insurance over CEFIs collateral and that CEFI also filed a motion to dismiss on the same grounds. The Debtor clarified that the issue of insurance is still pending. The parties filed a joint motion in state court to withdraw consigned funds and pay for insurance as stipulated (Dkt. ## 29, 44). The state court granted the joint motion but such funds had not been released yet. Per the state court order the funds will be released to CEFI and CEFI will pay for the insurance.The Debtor requested the court to continue this status conference considering the pending issues with CEFI and that the 341 meeting in this case is not concluded. The Debtor argued that they will be in a better position to inform the court of the status of the case and how to move forward. ORDER: For the reasons stated in open court, the status conference is continued to January 10, 2025 at 9:30 a.m. at Microsoft Teams Video & Audio Conferencing and/or Telephonic Hearings.The parties shall inform the court if by November 22, 2024 CEFI was allowed to inspect its collateral.
