This case was commenced as a Chapter 11 case that was filed on October 29, 2014, and was converted to Chapter 7 on February 24, 2015. English & Associates is a law firm which is owned and was operated by Jay English. On or about September 8, 2014, the business operations and the client files of the debtor were transferred to English Law Group, PLLC ("ELG"), another law firm owned and operated by Jay English ("English"). The trustee, through counsel, took over the prosecution of an action that had been prosecuted by the debtor, styled "Lee Berry, et al., Plaintiffs, vs. ACE American Insurance Co., et al., Defendants" and filed in the Dallas federal district court (the "Berry Action," No. 3:14-cv-1637-d). In the Berry Action, the trustee sought to recover from defendants, including Landmark American Insurance Company ("Landmark") attorneys' fees totaling approximately $1.8 million that were awarded in another lawsuit that the debtor commenced on behalf of former students of ATI Enterprises, Inc. ("ATI"). On January 21, 2014, ATI and affiliated entities commenced Chapter 7 cases in the bankruptcy court for the District of Delaware. On June 15, 2016, the trustee, through special counsel, filed a motion to annul the automatic stay to permit further prosecution of the Berry Action. On October 11, 2016, the Delaware bankruptcy court entered an order approving a joint stipulation between Jeoffrey Burtch, the bankruptcy ATI trustee, and trustee Reed resolving the motion to annul (the "Stipulation"). The Stipulation provided that trustee Reed's claim against Landmark in the Berry Action shall remain abated, but that $800,000 will be deposited into the registry of the Delaware bankruptcy court from the first recovery by trustee Burtch from the lawsuit he has separately commenced against the Insurance Companies. Trustee Burtch settled his lawsuit against the Insurance Companies and $800,000 of the settlement proceeds was deposited into the Delaware bankruptcy court registry (the "Registry Funds"). Counsel for trustee Reed and trustee Burtch thereafter negotiated a settlement of their respective claims to the Registry Funds whereby trustee Reed received $401,543.44 of the Registry Funds. This settlement was approved by the bankruptcy courts in the English & Associates and ATI cases. The trustee and ELG recently reached an agreement to compromise and settle the trustee's fraudulent transfer claims by the payment to the trustee of $7,500. Upon the court's entry of an order approving the settlement and once the settlement payment is received, the trustee will proceed with the necessary steps to close this case. (Reed, Diane) |
