Regarding the confirmation hearing, before the disclosure statement goes out, it will have to say if a deal has been reached or what the intent is. The objection deadline will be 1/21/2025 at 4:00 PM. If no agreement is reached before 1/17/2025, debtor's counsel will have to go forward with the confirmation hearing with no agreement as stated on the record. With respect to the existing disclosure statement, there is no letter of intent with She-Lends, LLC. To the extent a letter of intent with She-Lends, LLC is signed prior to 1/17/2025, that will be part of the confirmation testimony; if it is not signed, it will not be part of the testimony. Motion 63 is conditionally approved; debtors counsel has two days to get the plan out with the change that there is no letter of intent but expect to get one.
