| 08/12/2020 | On 8/12/2020, the Court held a hearing on the debtor's motion to sell property of the estate free and clear under section 363(f). Kristin Sederholm appeared for the debtor, Susan Knepel appeared for the FSA, and Chapter 12 trustee Rebecca Garcia appeared. The Court first questioned whether the real property at issue remained property of the estate or had revested in the debtor at confirmation, based on the language of the confirmed plan; the Court assumed for purposes of the motion that the debtor's real property (as opposed to personal property) remained property of the estate, making the section 363 motion necessary. The Court then turned to the issue of service, noting that service on both the FSA and Walworth County Treasurer did not comply with Rules 7004(b)(5) and (6), as required by Rules 6004(c) and 9014(b). Attorney Knepel waived the service defect on the record, and the Court indicated that it would grant the motion if the debtor provided evidence that Walworth County also had received actual notice and the motion and waived proper service, through County counsel or another officer authorized to accept service on behalf of the County.
